Portugal Article 90 Residence Permit - Legal Basis for HQA

Portugal Article 90 residence permit is the legal heading lawyers and hosts often cite for highly qualified activity residence under Portuguese immigration law (Law 23/2007, as amended). The article number is a map reference. It is not a substitute for the current implementing rules, salary floors, or the AIMA and consular document list in force when you file.

What Article 90 covers in practice

Article 90 sits in the statute that governs entry, stay, and removal of foreign nationals. In professional usage it is the hook for a residence permit tied to highly qualified professional activity in Portugal, typically with a Portuguese employer, university, or research host. The operative tests are not the two words “Article 90” on a cover letter. They are the role, the qualifications, the host, and the published conditions that sit under that heading at the date of the decision.

English marketing copy says HQA. Portuguese filings and legal opinions more often cite the article. Both labels can describe the same permit family. The dictionary of English names is on the Portugal Highly Qualified Activity visa page. The program narrative is on the Portugal HQA visa guide.

How Article 90 relates to an HQA file

A complete file still has to show that the activity is highly qualified under the rules that implement the article, and that the applicant can be admitted. That evidence is described, for working purposes, on HQA visa requirements. How the pack is lodged (consulate or in-country path, biometrics, card issuance) is described on the HQA visa application page. Article 90 does not pick the consulate for you and does not freeze 2026 processing times.

Amendments, regulations, and AIMA instructions change what a caseworker actually checks. Treat a citation in an old opinion or a blog post as a starting point. Confirm the current text and the current checklist before you rely on a paragraph number.

What Article 90 does not decide

The article number does not turn a real-estate purchase into highly qualified activity. It does not replace a D7 passive-income analysis. It does not, by itself, grant family cards, permanent residence, or citizenship. Those outcomes follow separate statutory tests after a period of legal stay. Citing Article 90 in an email is useful for alignment with counsel. It is not a decision.
